Cette branche du droit, dont ils se sont attachés à développer tous les domaines de compétence, était de force contraignante supérieure au droit civil particulier parce qu'elle se fondait sur l'unité du genre humain : le droit des gens était le droit de la société civile du genre humain. Mais à quoi l'expression « unité du genre humain » faisait-elle exactement référence ? Quel type d'universalité pouvait englober tous les hommes ? Et comment une thèse métaphysique a-t-elle pu fonder un corps de droit spécifique ? Le présent article entreprend de fournir des réponses à ces questions en procédant à une analyse lexicale et sémantique du vocabulaire mobilisé à cette époque pour le définir et le caractériser. | ||

They progressively developed all the competencies of this branch of law, who was by force binding superior to the particular civil law because it was founded on the unity of the human race: it was the right of the civil society of mankind. But what exactly did the expression "unity of the human race" refer to? What kind of universality could encompass all men? And how has it be possible to found a specific body of law on a metaphysical thesis? This article attempts to provide answers to these questions by conducting a lexical and semantic analysis of the vocabulary mobilized at that time to define and characterize the law of nations. | ||
