Die Capitula werden einer ausführlichen diplomatisch-kanonistischen Untersuchung unterzogen und ihre Bedeutung für die Papsturkundenlehre dargestellt. Behandelt werden die mit den Statuten verbundenen Datierungs probleme und die zahlreichen Missverständnisse bei der Auslegung sowohl ihres Wortlauts als auch ihrer äußeren Gestaltung. Es handelt sich ebenfalls um ihre merkwürdige Editionsgeschich te, die gesetzlichen Vorläufer und die Nachwirkung der Stauten. Die Rezeption der Capitula in verschiedenen Ländern, deren Aufnahme in das gemeine Recht und ihre Vereinbarkeit mit dem ius commune werden detailliert kommentiert. Als Nachweise dienen an erster Stelle einige im Straßburger Stadtarchiv erhaltene Originalbriefe. Diese Zeugen der Intensivierung der Häretiker bekämpfung unter Gregor IX. werden im Anhang ediert und erläutert; einige spätere Originalfas sungen der Capitula werden ebenfalls herangezogen. Zum Schluss wird mithilfe der erwähnten Originalurkunden im Straßburger Stadtarchiv die von Peter Segl entwickelte Theorie widerlegt, dass die Dominikaner im Reichsgebiet unter Gregor IX. noch nicht als Inquisitoren tätig waren. This article discusses the statutes of Gregory IX against the heretics promulgated probably at the end of 1230 or early in 1231: the Capitula contra Patarenos , also known as c. Excommu- nicamus et anathematizamus of the Liber Extra (X. 5.7.15). It offers a thorough diplomatic and canonical examination of the Capitula and demonstrates the importance of the statutes for the medieval papal diplomatic. The essay illustrates the problem of the exact publication date of the statutes as well as several misconceptions regarding the interpretation of their textual content and layout and tries to resolve them. It takes a closer look at the interesting history of their editions, their legal antecedents and of their aftermath and explains in detail the acceptance of the Capitula in the different countries, their inclusion in the common law and their compatibility with it. The study draws its main evidence from some original papal bulls in the archive of Strasbourg, as they bear witness to the growth of the combat of heresy under Gregory IX. These important documents are edited in the accompanying appendix and explained in detail; several later original versions of the Capitula are also taken as evidence. Finally, it offers a refutation, based on the original documents mentioned above, of the newly developed theory by Peter Segl that claims that the Dominican friars in the Holy Roman Empire were not appointed inquisitors by Gregory IX | ||
