Applicando un metodo analitico si approfondisce la disciplina delle persone giuridiche nell'ambito dell'Ordinamento statale italiano, a partire dalla loro definizione fino alla loro effettiva partecipazione alla vita pubblica attraverso le vie e nei limiti indicati dalla Legge. Di seguito con la disamina delle persone giuridiche cosiddette pubbliche, si focalizza l'attenzione sul regime giuridico geli Enti ecclesiastici italiani che, per loro scopi particolari, sono unici nel loro genere. Queste entità, infatti, costituiscono una realtà importante sul territorio italiano, per ovvie ragioni storiche e culturali e per questo motivo sono soggette ad una Legislazione peculiare. Diversa, invece, è la disciplina delle persone giuridiche previste dai Canoni del Codice di Diritto Canonico. L'opportunità per i fedeli di formare Associazioni riconosciute dalla Chiesa, è costituzionalmente garantita anche dalle Autorità civili competenti. Un breve acceno è fatto alle Norme civili e canoniche che regolano questo diritto. In particolare, si esaminano i limiti che vincolano gli Enti e la conseguente possibilità degli stessi di partecipare attivamente, se necessario, alla vita dello Stato e della Chiesa cattolica. Institutions and their essential elements have always engaged lawyers, for a detailed analysis, to configure as best they can their characteristics and legal status. Applying an analytical method, the regulation of legal persons is enhanced under Italian Law, from their definition to their effective participation in public life, by virtue of the ways and limits indicated in the Law. Below, with the examination of the so-called pulic legal persons, attention is focused on the legal regime of Italian Ecclesiastical Institutions which, given their particular purposes, are unique in their kind. Indeed, for obvious historical and cultural reasons, these entities constitute an important presence on Italian territory and it is for this reason that they are subject to special Legislation. However, the discipline of legal persons provided for by the Canons of the Code of Canon Law is different. The opportunity for the faithful to form assosiciations regognized by the Church, is also constitutionally guaranteed by the competent civil Authorities. A brief reference is made to the civil and canonical rules that regulate this right. In particular, an examination is made of the limits that are binding upan the Institutions and the consequent possibillity they have actively participate, if necessary, in the life of the State and the Catholic Church. | ||
