Summary:Because of the progressive secularisation and pluralisation of society, and as a result of the unification process of the European Union, questions of church-state law and religious constitutional law are becoming relevant once more. In determining the relationship between church and state, the "Böckenförde-Diktum" has long been cited. However, the analysis shows that Böckenförde's formulation poses considerable problems. Future ethical, theological and judicial reflections on religious constitutional law sholuld respect the transformed socio-cultural framework and view individual basic rights, particularly the basic rights of religious freedom, as a normative core.
