| 520 | |a Dopo una breve introduzione relativa al contenuto dell'Art. 9 della Convenzione Europea dei Diritti Umani, che sancisce il diritto alla libertà di pensiero, di coscienza e di religione, l'articolo prende in considerazione il diritto a manifestare il proprio credo religioso in ambito lavorativo, e i limiti entro i quali i lavoratori europei possono esercitarlo. In primo luogo, si è reso necessario considerare le specificità del settore pubblico e di quello privato. Successivamente, sono state analizzate le aree relative ai Ricorsi in materia che presentano un maggior numero di pronunce della Corte Europea dei Diritti Umani (casi concernenti l'esercizio di particolari mansioni, l'orario di lavoro e l'utilizzo di indumenti e simboli religiosi), al fine di valutare quali indicazioni gli Stati membri possano trarre in merito alla tutela del diritto in esame. In conclusione, si è sottolineata l'attualità della tematica e l'urgenza di una risposta adeguata al problema, in considerazione del ruolo centrale che occupa il lavoro nella vita di ogni essere umano, nonchè della rinnovata importanza che ha assunto la religione nell'era della globalizzazione. After a brief introduction on the content of Art. 9 of the European Convention on Human Rights, which recognises the right to freedom of thought, conscience and religion, this article considers the right to manifest one's religion in the workplace, and the limits within which European workers may exercise this right. Firstly, if has been necessary to take into account the peculiarities of public and private sectors. Then, there have been analysed the areas of Cases concerning religious accommodation in the workplace which have the highest number of decisions of the European Court of Human Rights (cases concerning work tasks, work schedules and the wearing of religious attire), in order to determine what guidance Member States can draw for the protection of the right examined. Finally, it has been underlined how topical this issue is and how urgent is the need to provide an adequate response, this, in view of the central role occupied by work in everyone's life, as well as the renewed importance of religion in the era of globalisation . | ||
