Este artículo hace referenia a este aspecto capital del Derecho matrimonial estudiando primero esta institución el el Derecho romano para desarrollar en la segunda parte todas las consecuencias que etsa facultad posee en el Derecho moderno, especialmente en lo que se refiere a la limitación de dicho derecho por el medio de impedimientos matrimoniales. Estudia igualmente el aspecto derivado de dichas prohibiciones matrimoniales como es la nulidad del consorcio contraído en presencia de una prohibición irritante. Finalmente se analiza la relación entre el Derecho y la realidad de las cosas en nuestro tiempo, así como su influencia en la concepción jurídica del derecho al matrimonio. The natural right of every human being to marry was already dealt with in Roman Law. The article refers to this important aspect of marriage law by first studying this institution in Roman Law in order to develop, in the second part, all thr consequences which this faculty has in modern law, with special reference to the limitation of said right by means of matrimonial prohibitions, such as the nullity of the consortium contracted with such an irritant prohibition. Finally, it looks at the relationship between law and our contemporary reality, and also its influence on the juridical concept of the right to marry | ||
