Jeder Rechtsbruch setzt voraus, dass Recht als spezifische symbolische Form eine regelgeleitete Ordnung darstellt, deren Fortfolge stets mit Variationen einhergeht. Nicht jeder Bruch im Recht ist somit ein Rechtsbruch oder auch ein Abbruch des Regelsystems, sondern kann auch eine Rekonfiguration darstellen, um neuen Herausforderungen für das Recht entsprechen zu können. Von daher sind vornehmlich Willkür und Gewalt diejenigen Modi von Rechtsbrüchen, die der inneren Natur des Rechts als Kulturform widersprechen. Vor diesem Hintergrund lässt sich die »Rule of Law« auch dann verfassungsrechtlich aufrechterhalten, wenn zugleich innerhalb des Zivilrechts rechtsplurale Räume implementiert werden würden. | ||
| 520 | |a The article deals with modes and structures of law-breaking, not from the perspective of jurisprudence or legal studies, but from the perspective of a cultural theory of law. Thereby, the argumentation mainly follows the insights of Ernst Cassirer´s understanding of law as a distinctive »symbolic form«. Public debates about legitimate breaks of the »Rule of Law« can relate to several levels of formal legal systems: from civil and penal law up to constitutional law and its legal interpretation. However, any legal system is shaped and formed by a specific structure of order, with different kind of rules, and forms of variation. Therefore not in every case breaking a legal rule means its violation. Legal variation can also in the long run lead to a new legal system of order (and norms) dependent on what kind of challenges it has to face to and by which kind of instruments it is implemented. In any case, due to the inner essence of law as symbolic form, violence and arbitrariness have to be excluded because. In the end, the article tries to argue that even a legal pluralism within civic law systems must not be seen as a fundamental break within and of the applicable »Rule of Law«. | ||
