Zur theoretischen Fundierung folgen drei Thesen über den immanenten Zusammenhang von Strafe und sozialer (Un)Gerechtigkeit. Abschließend führt die Autorin das Konzept der transformativen Gerechtigkeit als alternatives Paradigma zur Strafgerechtigkeit ein und zeigt dessen praktische Konsequenzen auf. | ||
| 520 | |a The article deals with the relationship between the breach of law and punishment from the angle of justice theory. As a first step, the author argues why social justice as a background condition of individual behaviour matters when analysing legal punishment. In a second step, the article introduces different justifications for punishment and contrasts them with a theoretical account based on social power, which demands the abolishment of punishment. In order to provide further philosophical grounds for this demand, the author introduces three propositions on the immanent relationship between retribution and social inequality. By way of conclusion, the article discusses the novel concept of transformative justice as an alternative paradigm of action that moves beyond punishment. | ||
