Mais alors même qu'il faisait échouer une réforme visant à débarrasser le droit hindou de ses aspects inégalitaires, le Parlement adoptait à la quasi-unanimité l'article 2 du Hindu Code Bill qui intégrait dans la catégorie légale « hindou », outre les hindous eux-mêmes, les bouddhistes, les jains et les sikhs - définition restée en vigueur à ce jour. S'opposèrent toutefois à être légalement assimilés à des hindous les représentants des sikhs. Je considère dans un premier temps les arguments développés par B. R. Ambedkar pour démontrer que l'identité hindoue ne dépendait pas de la religion au sens strict mais de l'ordre social et juridique qui s'était historiquement constitué sur le territoire indien hindouisé. Je montre en conclusion que l'interprétation de la définition inclusive de « hindou » continue d'être débattue. | ||

Ambedkar, the Justice Minister in the first Nehru government, leading to his resignation. But even when it led to the failure of a reform that attempted to rid Hindu law of inegalitarian aspects, the parliament adopted almost unanimously Article 2 of the same bill, which joined in the same legal category of "Hindu" –in addition to Hindus–, Buddhists, Jains and Sikhs, a definition that remains in force today. Representatives of the Sikhs rejected being assimilated with Hindus in legal terms. I review here the arguments used by Ambedkar to convince the Sikhs that the Hindu identity did not depend on religion in the strict sense, but rather on the social and legal order historically constituted in Hinduized Indian territory. I show in conclusion that the inclusive definition of "Hindu" remains in dispute. | ||
