| Zusammenfassung: | Since his accession in 2012, Coptic Orthodox Pope Tawadros II has initiated a number of reforms within the church, including a major overhaul of the church court system and the introduction of more liberal provisions concerning divorces. This article explores the historical development and current state of divorce and divorce law within the Coptic Orthodox Community in Egypt and the complex interactions between Coptic citizens, their church, and state courts. Scrutinising interviews and press statements by the new pope and senior clerics, it investigates their ideas of Coptic family law and their justification for changing the Church's approach to the divorce issue. It also takes the perspective of divorced Copts and looks at the myriad paths people have been following in search of legal and administrative loopholes, and assesses the impact that the new regulations will have on their lives. Depuis son accession en 2012, le pape copte orthodoxe Tawadros II a mis en œuvre une série de réformes au sein de l'Église copte, y compris une refonte majeure du système des tribunaux ecclésiaux et l'introduction de dispositions plus libérales en matière de divorce. Cet article examine l'évolution historique du divorce et du droit légiférant le divorce au sein de la communauté copte orthodoxe en Égypte et les interactions complexes entre les citoyens coptes, leur Église et les tribunaux d'État. Sur base des interviews et des déclarations à la presse du nouveau pape et des hauts dignitaires religieux, l'article analyse leurs conceptions du droit de la famille copte et leurs justifications pour changer la vision de l'Église quant à la question du divorce. Enfin, cet article adopte également le point de vue des Coptes divorcés en étudiant la multiplicité des voies que les personnes concernées ont suivies à la recherche des failles juridiques et administratives, et en évaluant l'impact de la nouvelle réglementation sur leur vie. |
