Von dieser sehr fortschrittlichen Position aus stellt sich allerdings die Frage, wie nach Abaelard der Fall zu behandeln ist, bei dem jemand einem Irrtum unterliegt, wie dies der Fall bei den Peinigern Jesu zu sein scheint, um deren Vergebung Jesus nach Lk 23 bittet. Ein Vergleich mit der Irrtumslehre des modernen Strafrechts zeigt die Aktualität und Grenzen des Ansatzes Abaelards. | ||
| 520 | |a The goal of this article is to present Peter Abelard’s (1079–1142) moral philosophy, as developed in his text Ethica – scito te ipsum (ca. 1139). One main characteristic of this ethics is that Abelard counts only the intention of an action as the object of moral judgment. The question that arises from this very modern position, however, consist in how to deal with the situation presented by Abelard, in which someone is making a mistake, as seems to be the case with the persecutors of Jesus, whose forgiveness Jesus seeks according to Luke 23. Finally, a comparison with the tort law in the modern criminal system should show the outgoing contemporaneity of Abelard’s thought, together with the limitations of his approach. | ||
