Que ce soit à travers la voie législative ou contentieuse, le droit brouille les frontières de la summa divisio qu’il posait jusqu’alors entre les personnes et les choses. Ainsi, les animaux, voire la Nature dans son ensemble, se voient parfois reconnaître le statut de sujet de droit. La présente contribution a pour objectif de faire la lumière sur les présupposés anthropologiques et normatifs accompagnant les récentes stratégies juridiques déployées par divers acteurs afin de protéger les animaux. L’enquête vise à repérer les différentes manières pour le droit de saisir les rapports entre humains et animaux et d’identifier ainsi les éventuelles traces d’un glissement vers un paradigme post-humaniste. | ||

Whether through legislation or litigation, the law is blurring the boundaries of the summa divisio that it used to place between persons and things. Thus, animals, and even Nature as a whole, are sometimes recognized as subjects of law. This article will shed light on the anthropological and normative presuppositions accompanying the recent legal strategies deployed by various actors to protect animals. Our investigation aims to identify the different ways in which the law has come to grasp the relationship between humans and animals and thus to identify possible signs of a shift towards a post-humanist paradigm. | ||
