Pubblicato nel 1758, il trattato - tra i numerosissimi aspetti studiati - analizza il tema dello ius migrandi. Nella combinata e congiunta prospettiva d'analisi rappresentata dal diritto naturale e dal diritto delle genti, il giurista elvetico studia il concetto di migrazione con riguardo a due specifici aspetti: da una parte, il diritto di abbandonare il proprio paese e dall'altro "il diritto di abitare in qualche parte". Sotto il primo profilo l'Autore si interroga circa la sussistenza ed il contenuto del diritto del singolo cittadino ad abbandonare il paese e la società di cui è membro ponendo particolare attenzione al concetto ed al ruolo del patto di società. Sotto il secondo profilo d'analisi il fenomeno migratorio viene analizzato in riferimento al diritto naturale dell'uomo di "abitare in qualche parte". Il tema si congiunge dunque al delicato tema del diritto di asilo. Questa duplice prospettiva apre il quadro argomentativo su un ulteriore complesso e controverso aspetto: delineare quali siano i doveri (e al contempo i diritti) di una Nazione verso soggetti migranti richiedenti asilo ed accolti o stanziati sul proprio territorio. | ||

Published in 1758, the treatise - among the many aspects studied - analyzes the theme of the ius migrandi. In the combined perspective of natural law and the law of nations, Vattel studies the concept of migration with regard to two specific aspects: on the one hand, the right to leave one's own country and on the other "the right to live somewhere". Under the first profile, the author questions the existence and the content of the right of the individual citizen to leave the country and the society of which he is a member, paying particular attention to the concept and role of the social contract. Under the second profile of analysis the migration phenomenon is analyzed with reference to the natural right of man to “live somewhere”. The theme is therefore linked to the delicate issue of the right to asylum. This dual perspective opens the argumentative framework on a further controversial aspect: the duties (and at the same time the rights) of a Nation towards asylum seekers. | ||
