520 |a The aim of the essay is to stress the privacy evolution within the EU with regard to the entry into force of the GDPR, starting with its regulatory structure that characterizes this Secondary Law instrument. Initially, in fact, all the safeguards provided for the transfer of personal data to Third Countries to the EU will be brought to light, as they are necessary in order to ensure the lawfulness of such data transfers. Thereafter, account shall be taken of the derogations intended to be implemented in the event that, although the Regulation guarantees are not applied, the criteria established for such derogations established under the GDPR are fulfilled. It is to be noted that, such criteria are characterized by the existence of a legitimate interest through which the GDPR fills the gap in that legal basis: solely provided. 
520 |a Lo scopo del presente contributo è di evidenziare l’evoluzione che il concetto di privacyha subìto all’interno del contesto europeo in relazione all’entrata in vigore del GDPRpartendo proprio dalla struttura normativa che contraddistingue siffatto strumento di Diritto derivato. Dapprima, infatti, saranno portate alla luce le garanzie poste alla base del trasferimento di dati personali verso Paesi terzi all’Ue, poiché necessarie alla li-ceità di tale tipologia di trasferimento. In seguito, invece, si darà conto delle deroghe destinate a trovare attuazione nell’eventualità in cui, pur non trovando applicazione le garanzie del Regolamento, comunque ricorrano le condizioni che il GDPR pone alla base di ogni singola deroga. Tali condizioni, si precisa, sono caratterizzate dalla sus-sistenza di un legittimo interesse mediante il quale, il GDPR, colma l’assenza di quella base giuridica che solo le garanzie del Regolamento stesso possono fornire.
