L’universalité des droits humains est un idéal qui cherche à réconcilier la nécessaire prise en compte du monde dans sa totalité et son unicité et le respect de la diversité culturelle, des traditions nationales, des spécificités historiques et géographiques. Une telle conception repose sur l’idée de l’éthique de la réciprocité. Il est même possible de dire que les droits humains sont des droits que nous nous reconnaissons mutuellement. C’est l’idée de l’inscription de droits dans une communauté humaine. Par le système conventionnel européen, les autorités nationales ont accepté de se soumettre au contrôle subsidiaire de la Cour qui est chargée de vérifier si, tout bien pesé, le standard minimum de protection a finalement été respecté. | ||

To speak of human rights leads quite naturally to the affirmation that these rights are universal, for humanity is one. The universality of human rights is an ideal that seeks to reconcile the need to take account of the world in its totality and its unicity with respect for cultural diversity, national traditions, and distinctive historical and geographic characteristics. This conception is based on an ethic of reciprocity; one can even say that human rights are rights that we recognise in one another. This is where we locate the idea of the inscription of rights in a human community. Through the European treaty system, national authorities have agreed to submit themselves to the subsidiary control of the Court, which is charged to verify whether, on balance, they have respected a minimum standard of protection of human rights. | ||
