Si l'on prend comme fil conducteur la distinction entre concept et idée du droit (Philosophie des Rechts, § 1), on parvient à la comprendre de manière positive : son abstraction permet au droit abstrait d'être la structure formelle et comme anhistorique de tout rapport social. l'effectuation du droit abstrait/privé dans la société civile au sens spécifiquement hégélien du terme manifeste la fécondité de cette abstraction, dès lors qu'elle est mise en relation avec son sol historique propre : le social, qu'il est désormais possible et nécessaire de distinguer du politique. Il reste que le politique, quant à lui, ne saurait être pensé en termes juridiques; c'est ce que montre, parallèlement à la critique bien connue du contractualisme, la double thématique du « droit des héros » et du « droit de l'esprit du monde », qui dessine pour ainsi dire les marges de l'espace de la politique et de l'histoire. Hegelian thought reputedly marks little favour for Law which it qualifies as being abstract and formal. But this abstract quality ought not to be taken in a purely negative sense. If one were to take as a lead the distinction between concept and idea of law (Philosophie des Rechts, § 1), one would arrive at a positive understanding of this quality: it allows abstract law to be formal and anhistoric, as it were, structure of every societal relationship. Effectuating abstract/private law in civil society, in the specifically Hegelian sense of the word, reveals, when placed in relationship to its own historical ground, the fecundity of this abstract quality: the societal, which can and must henceforth be differentiated from the political. As for the latter, it no longer bears being thought in juridical terms; this is shown, parallel to the well-known critique of contractualism, by the double theme of the « Right of Heroes » and of the « Right of the Spirit of the World », which themes draw the lines, one might say, of political and historical space. | ||
