| 520 | |a Although there is unambiguously a penetration of national laws by a more and more common European Union religious law since the Maastricht treaty in 1992 it is noticeable that value and identity conflicts are afresh inflammable—on the one hand vertically between the European Union and the nation states and on the other horizontally between the nation states. This article try to illustrate this and to focus subsequently on the question how populism take up the fact that divergent national law trends contradicts the thesis of a unidirectional development to a common European religious law. The forces who seize politically on these conflicts are not only right-populists but also conservatives. That is why the question arises which relationship there is between populism and conservativism in this context. The answer ca be as follows: Whereas right populists frequently relativize the individual freedom of religion intonating an interplaying triad of restrictive migration, anti-Islamisation and "Christian-Jewish" identity politics, Conservative ones separate the threads more from each other and mostly do not want fall short of the contemporarily predominating European religious law resp. human rights standard. | ||
| 520 | |a Nationale Staat-Kirchen-Verhältnisse werden zunehmend von der europäischen Gesetzgebung und Rechtsprechung tangiert und durchdrungen. Im vorliegenden Beitrag soll gezeigt werden, wie sehr Werte- und Identitätskonflikte sowohl vertikal zwischen der EU und den Nationalstaaten als auch horizontal zwischen den Nationalstaaten dadurch neu entflammt werden und wie der Populismus dies gezielt aufgreift und damit identitätspolitische Auseinandersetzungen vorantreibt und auslöst. Die damit einhergehenden Wertekonflikte werden indes nicht nur von "populistischen", sondern auch von konservativen Parteien und Strömungen aufgegriffen. Daraus ergibt sich zudem das theoretische Problem der Verhältnisbestimmung von Populismus und Konservativismus im religionspolitischen Kontext. Relativieren Rechtspopulisten in einem unentwirrbar von ihnen intonierten Dreiklang aus restriktiver Migrationspolitik, Anti-Islamisierung und christlich-jüdischer Identitätspolitik zumindest teilweise das Prinzip der individuellen Religionsfreiheit gemäß des heute vorherrschenden europäischen Menschenrechtsstandards, trennen Konservative die genannten Stränge stärker voneinander und wollen zumeist nicht hinter dem genannten verfassungsrechtlichen und rechtspraktischen Status Quo zurückfallen. | ||
