| Summary: | Über Kooperations- und Austauschbeziehungen zwischen Medien und Gerichten ist in den Prozessordnungen nichts bekannt. Diese gehören damit zum informellen Verfahren der Entscheidungsbildung. Es ist schwer einzuschätzen, welche Nebenfragen das Handeln um und mit Informationen, die Zusicherung von Exklusivität, die gezielte Indiskretion und der spektakuläre Medienauftritt haben. Es geht auch die Öffentlichkeit an, wie die Verstrickung von Journalist:innen in die Prozessführung auf sein/ihr Rollenverständnis und seine/ihre Informationsaufgabe einwirken. Die informelle Verfahrensbeteiligung der Medien und die Beteiligung der "Organe der Rechtspflege" bei der Information und Unterhaltung der Öffentlichkeit sind nicht nur Themen für die Sozialwissenschaft, sondern auch für das prozessuale Verfahrensrecht sowie das Medienrecht. Nothing is known in the judicial procedural codes concerning the cooperation and exchange relationships between the media and the judiciary. Thus, these are part of the informal process of decision-making. It is difficult to assess the ancillary issues of trading for and with information, assurances of exclusivity, purposeful indiscretion, and spectacular media exposure. The involvement of journalists in the conduct of the trial, which affects is understanding of its role and its task of providing information, also concerns the public. The informal procedural participation of the media and the involvement of the "organs of justice administration", in informing and entertaining the public, are not only topics for social science, but also of procedural law as well as media law. |
