Summary:In our system of laws religions do not have direct authority for the constitution of generally obligatory right. Instead religions are »the subject« of legal regulations and must sometimes be also judged. The essay discusses first briefly the scope and the range of the relationship between religion and right, established in our western societies. Second, the essay will outline a historical review of the genesis of this structure. It is shown that the separation from religion and right is not the result of a modern development, because it was politically effective already since the antiquity in different ways. The connection of Greek-Roman right systematic with the Jewish-Christian view of the law as divine instruction gave rise to the juxtaposition of the two institutions state and church. The modern freedom of religion is a new way of the relation between the separated spheres of right and religion. The separation is given already for centuries and can appear therefore in the European and western thinking as it were natural. It is developed however as a conflict resolution model, which can have an important meaning again in today's intercultural communication.
