| Summary: | This article deals with some of the methodological differences between Maimonides' Commentary on the Mishnah and his code, Mishneh Torah. The first part of the article presents the different goals of these two works. The goal of the Mishnah-commentary is to present only the major principles of halakhah, while in Mishneh Torah Maimonides includes all the details and sub-rules of halakhah. Furthermore, while the Commentary on the Mishnah is meant to be used as an introduction to the Talmud and as a general-theoretical summary of the halakhah, Mishneh Torah is a detailed practical-halakhic code. Attention to the different goals and methodologies of these two books could help us to understand some of the contradictions between Maimonides' writings in these two books. The second part of the article illustrates methodological differences between these two books regarding the following aspects: extent of legal coverage, modes of categorization, and conceptual refinement. |
