| Summary: | In Polish law, among many constitutional principles, there is the principle of subsidiarity. In the context of family, the understanding of the principle in Polish legal system and in the Catholic teaching is quite similar. The aim of the article is to examine if the principle in question is present in the provisions of family law. The conclusion is that sovereignty of families is well safeguarded in Polish law by the means of the principle in question. To protect autonomy of family, one must not demand that the laws be changed, but rather that the principle be respected in application of the family law. |
