| Summary: | The administration of civil justice in Venice in the modern age is a field of research so far only superficially explored. The article aims to investigate this topic from a double point of view: on one side it defines the ju risdicti ona l duties assigned to the main Venetian magistrates, highlighting the connections and the interactions existing between the different levels of ju risdiction; on the other side it proposes a case study in order to test the actual effectiveness of the tria l in everyday reality. In this perspectiv e the heredi tary dispute between a noble widow and the nephew of her late husband contributes to outline the features of a judicia l system that in the second half of the Eighteenth century was still fit to intercept the demands for justice coming from society. L'amministrazione della giustizia civile a Venezia in età moderna rappresenta un ambito della ricerca ancora poco noto. Il presente articolo si propone di investigare questo tema da un duplice punto di vista: da un lato s'intende ricostruire la sfera delle competenze giurisdizionali assegnate alle principali magistrature veneziane, evidenziando le connessioni e le interazioni esistenti tra i diversi livelli di giudizio; dall'altro si ritiene indispensabile lo studio della casistica per verificare l'effettivo funzionamento del sistema processuale nella realtà quotidiana. In tal senso la controversia ereditaria tra una nobildonna rimasta vedova ed il nipote del marito defunto contribuisce a delineare i tratti caratteristici di un ordinamento che nella seconda metà del Settecento era ancora in grado di intercettare le istanze di giustizia provenienti dalla società civile. |
