| Summary: | Legislation on sexual violence was inspired and encouraged by important social and cultural transformations - the sexual revolution and the feminist movement -that saw women transform themselves into authoritative moral subjects, capable of changing the rules of the laws. In this legislative evolution, the establishment of the concept of victim as a privileged rights-holder played an important role. This affirma-tion came about due to the persecutions suffered during World War II and was then acquired by the feminist movement, which placed it at the center of its revindications together with the concept of consensus. Victims are those people whose consensus is neither invited nor respected, and the law is organized around the protection of their integrity and will. These profound cultural transformations have women for protagonists and are in part neither adequately recognized nor valued. |
