| Summary: | Examinamos três instrumentos normativos produzidos ou aprovados no âmbito do legislativo federal brasileiro: o Estatuto da Igualdade Racial, o Acordo Brasil-Vaticano e o projeto conhecido como Lei Geral das Religiões. O Estatuto da Igualdade Racial (Lei 12.288/2010) foi encampado pelo Estado brasileiro no quadro de discussões sobre ações afirmativas e o modo como enquadra os direitos das “religiões de matriz africana” a partir de uma perspectiva étnica constrói continuidades em relação à via de afirmação diferencialista destas no espaço público. O Acordo Brasil-Vaticano (Decreto 7107/2010), tramitado no Congresso Nacional após negociações com o governo federal, está voltado para as condições de existência da Igreja Católica, com um tom particularista na leitura da produção de direitos religiosos. Reação das “bancadas evangélicas” em relação à conquista dos católicos, a Lei Geral das Religiões (PL 160/2009) fala em nome de todos os grupos religiosos na garantia de direitos. A análise busca contextualizar os textos normativos, marcando as passagens e mudanças entre perspectivas generalistas e particularistas. Contribui para caracterizar, em termos de regulação do religioso, os arranjos propostos por estes instrumentos entre religiões e o Estado, tendo como foco os entendimentos acerca do princípio da liberdade religiosa. This study analyzes three legal instruments produced or approved under the Brazilian federal legislation: the Statute of Racial Equality, the Brazil-Vatican agreement and the bill known as the general law of Religions. The Statute of Racial Equality (Law 12.288 / 2010) was taken by the Brazilian State as part of the discussion about affirmative actions. The way it frames the rights of "religions of African origin" from an ethnic perspective maintain continuities in relation to differentialist definitions of those in public sphere. The Brazil-Vatican agreement (Decree 7107/2010), conducted in the National Congress after negotiations with the federal government, prioritises the conditions of existence of the Catholic Church, with a particularistic tone in the reading of the production of religious rights. The reaction of the 'evangelical benches' towards the achievement of the Catholics, the general law of Religions (PL 160/2009) aims to speak on behalf of all religious groups in the warranty of their rights. Our analysis seeks to contextualize the normative texts, highligthning the passages and changes between general and particularistic perspectives. It contributes to characterize as forms of regulating religions the arrangements between religion and State set by these instruments, focusing on the definitions about the principle of religious freedom. |
