Prendendo spunto dal legame, esplicitamente identificato dal legislatore spagnolo, tra la reforma concursal de mecanismo de segunda oportunidad, Rdl 1/2015, de 27 de febrero y Ley 25/2015, de 28 de julio, sul beneficio de exoneración del pasivo insatisfecho e la Ley 3a, Título XV, Partida V, della Ley de las Siete Partidas, l’articolo ha lo scopo di mostrare il fondamento romanistico di questa legislazione e il cruciale ruolo di Alfonso X nell’affermazione storica di un più umano trattamento del ‘debitore meritevole’. |
