| Summary: | This essay deals with various issues of religious freedom and state-church relations that arose during and in connection with the Revolution of Dignity and the military and political conflict between Ukraine and Russia. I do not propose any completed answers, but I rather formulate the question which answers need, based on the fact that one of the reasons that led to both EuroMaydan and the annexation of the Crimea and the war on the Donbass is the European choice of Ukraine. This choice does not only mean the institutional integration of Ukraine into certain European structures. First of all, it predetermines the perception by the Ukrainian society and the state of a certain set of legal values (the rule of law, democracy, respect for human rights, etc.) and related values and principles that must be embodied in domestic law and order. It should also be emphasized that the following considerations are considerations of a lawyer. I do not have sufficient qualifications for religious or political analysis, and I propose only a look at the religious freedom and relations between the state and the church, which focuses on the above legal values. Це есе стосується різних питань релігійної свободи і державно-церковних відносин, які постали під час і у зв’язку з Революцією гідності і військовим і політичним конфліктом між Україною і Росією. Я не пропоную якихось завершених відповідей, а скоріше формулюю питання, які таких відповідей потребують, відштовхуючись від того, що однією з причин, через які стався і Євромайдан, і анексія Криму, і війна на Донбасі, є європейський вибір України. Цей вибір не означає лише інституційну інтеграцію України у певні європейські структури. Він, передусім, зумовлює сприйняття Українським суспільством і державою певного набору правових цінностей (верховенство права, демократія, повага до прав людини тощо) і пов’язаних з цими цінностями принципів і правил, які мають бути втілені у вітчизняному правопорядку. Варто також підкреслити, що наведені нижче міркування є міркуваннями юриста. Я не маю достатньої кваліфікації для релігієзнавчого чи політологічного аналізу і пропоную лише погляд на релігійну свободу і відносин держави і церкви, що фокусується на вказаних вище правових цінностях. |
