| Summary: | The recent Advisory Opinion of the International Court of Justice on the illegality of Israel's continued presence in the Occupied Palestinian Territories has been regarded as groundbreaking. Beyond its implications for Israel's illegal occupation, it can be put in service of a broader decolonising agenda. First, the Advisory Opinion provides an opportunity to promote a structural approach to international legal remedies for the colonisation of Palestine. Second, it may have a spill-over effect by paving the way for international criminal prosecutions at the International Criminal Court or based on the principle of universal jurisdiction. Third, it could produce a ripple effect inside the Green Line, capable of challenging settler-colonial structures of Israel. |
