Elle envisage donc la bioéthique, au plan législatif, non comme un ensemble de garde-fous face aux évolutions des techniques mais comme l’octroi de nouveaux droits utilisant ces techniques. Au-delà de la procréation, la loi desserre aussi les contraintes de la recherche et du don d’organe ou de l’information génétique. Ce faisant, elle détermine de nouveaux équilibres entre droits subjectifs et ordre de protection, que le Conseil constitutionnel n’a pas souhaité examiner. | ||

It therefore looks bioethics, at the legislative level, not as a set of safeguards against the evolution of technologicals resources, but as the granting of new rights using these technologies. Beyond procreation, the law also loosens the constraints on the research and organ donation or genetic information. In so doing, it determines new balances between subjective rights and protective orders, which the Constitutional Council did not wish to examine. | ||
